Smart Contracts als Risiko für Informatiker

Zusammenfassung

Smart Contracts stellen nicht nur Automatisierungsmöglichkeiten in Blockchains dar, sondern können auch rechtlich bindende Verträge abbilden. Dieser Beitrag diskutiert unterschiedliche Facetten der Anwendung von Smart Contracts und dem möglichen bzw. sinnvollen Umfang der rechtlichen Willensabgabe sowie die Rechtsfolgen von Erfüllung und Leistungsstörungen auf der Blockchain. Zudem zeigt ein kurzer Überblick über das Rechtdienstleistungsgesetz, wo der Gesetzgeber Softwareentwicklern in der Erstellung von Smart Contracts Grenzen setzt und wie diese sich vor Haftung schützen können.
