Zusammenfassung

Herrschaft ist nach Max Weber im Alltag vor allem Verwaltung. Vor dem Hintergrund dieser Feststellung befasst sich dieser Beitrag mit dem institutionellen Kontext von Verwaltungshandeln im federal government der USA, der Struktur der Verwaltung, sowie ihrem Personal und seiner Rekrutierung. In einem zweiten Schritt wird die Frage nach dem Einfluss von Verwaltungen auf legislative und administrative rule making beantwortet. Der Text schließt mit einem Blick auf die Interaktion von federal bureaucracy und dem 45. Präsidenten der USA, Donald J. Trump. Dabei werden vor allem die Gefährdungen eines regel- und rechtsgebundenen Verwaltungsbetriebes durch den amtierenden Präsidenten in den Blick genommen.

    Folgt man Levitsky und Ziblatt (2018), dann stehen nicht nur die Funktionsweise der Verwaltung, sondern wesentliche Teile der verfassungsmäßigen institutionellen Ordnung der USA in Frage. Diese Anfechtungen werden in anderen Teilen dieses Bandes verhandelt und nur hier erwähnt, wenn sie für das Verständnis von Prozessen und Veränderungen in der Ministerialverwaltung der USA bedeutsam sind.

    Das Executive Office of the President (EOP) wird im Kontext dieses Kapitels nicht erörtert.

    Gleichwohl ist die Zahl von political appointments ungleich höher als in fast allen anderen Ländern der Welt. So werden in der Bundesrepublik Deutschland nur Staatssekretäre und Abteilungsleiter in den Bundesministerien politisch besetzt. Das sind insgesamt im Jahre 2019 ca. 150 Personen.

    Der Begriff „deep state“ wurde von Lofgren in einem Artikel (Lofgren 2014) geprägt und bezieht sich vor allem auf die öffentlich und dennoch abgekapselt agierenden sicherheitspolitischen Strukturen und Dienste in den USA, die vom EOP durch den National Security Council koordiniert werden.

    Auf wissenschaftlicher Seite wird dies reflektiert durch eine konservativ geprägte Debatte um den sogenannten administrative state, eine Verwaltung, die weit mehr Einfluss nimmt, als von der Verfassung vorgesehen und die dabei von Gerichten, die zu viel Eingriff der Verwaltung in das tägliche Leben zulassen, nicht gebremst wird. Eine ausführliche Darstellung dieser Position ist Postell’s Buch „Bureaucracy in America“ (2017).

    Scott Pruitt trat im Juli 2018 nach Korruptionsverdacht und massiven Vorwürfen über den Missbrauch öffentlicher Gelder nach etwas mehr als einjähriger Amtszeit zurück.
