Abstract

This chapter presents a general overview of the juvenile delinquency and the juvenile justice system in Turkey based on the main components and principles of Turkish Legislation. Since 1979, Turkey has had juvenile laws in place. However, the country did not see significant reforms in its juvenile justice system until it ratified the Convention on the Rights of the Child in 1994. The Child Protection Law aimed at providing protection for children involved in the justice system as perpetrators, victims or witnesses at any phase of the legal process, came into force in 2005. At the same time, a new Criminal Code and the Code of Criminal Procedure, as essential parts of new legal reforms of Turkey, were enforced. This chapter also includes statistical information about the juvenile population in prisons and trends in juvenile crimes over the years 2004–2014 and reviews the major causes of juvenile delinquency in Turkey. Besides the rules of policing juveniles, the elements and procedures of the juvenile justice system will be explained such as juvenile courts, juvenile judge, and social workers. Lastly, the custodial rules of juveniles, the execution institutions for juveniles and reformatories, and alternative sanctions for juvenile offenders in the Turkish Justice System will be mentioned in the final section of the chapter. Although there has been a radical transformation over the last decade in the Turkish Juvenile Justice System, there are still significant inadequacies, especially on measuring decisions and alternative sanctions and probation services in practice..
