Zusammenfassung

Die rechtliche Grundlage für das Verhältnis des Landesherrn zu den Domänen ist noch immer eine rein privatrechtliche. Wie im Mittelalter der ganze Staat als Privateigentum des Fürsten gegolten hatte, so noch jetzt die Domänen. Von anderm Privateigentume unterscheiden sich die Domänen nur dadurch, daß die Einkünste wie im Mittelalter für die Verwaltung des Staates verwendet wurden,2) während die Stände zu Beihilfen nur verpflichtet waren, soweit die Einnahmen aus den Domänen und Regalien nicht ausreichten.
