Abstract

Some judicial review mechanisms are successful whereas others are not. It has been argued here that a constitutional court becomes a powerful political actor when its opinion is sought increasingly by politicians to resolve political disputes regarding the distribution of power within the government. In order to become powerful, its decisions must also be respected and enforced by other political actors. This does not happen in every instance.
